Judge Dismisses xAI Trade Secrets Claim Against OpenAI

A US federal judge has dismissed a lawsuit by xAI against OpenAI. The lawsuit claimed OpenAI misappropriated trade secrets. This is the second time US District Judge Rita Lin has dismissed the case. She previously allowed xAI to amend its complaint, but this latest dismissal did not offer that opportunity. The judge ruled xAI failed to fix the issues in its earlier claim. The original complaint, filed in February, alleged OpenAI induced a former xAI senior engineer to disclose trade secrets. However, Judge Lin found xAI did not show how OpenAI encouraged this disclosure. The allegations only applied to the engineer, not to OpenAI itself. The judge stated that merely asking an applicant to discuss previous work, a routine part of hiring, does not mean OpenAI induced the revelation of confidential information. She also noted that simply possessing trade secrets is not enough to prove misappropriation. This decision clarifies the high bar for proving trade secret inducement in the competitive AI industry.
